Following Decree 2016-418 of the Macron Law, effective 1 July 2016 the transportation sector is required to submit through the SIPSI portal:
- l’Attestation de Détachement d’un travailleur roulant ou navigant dans le cadre de l’exécution d’une prestation de service par une entreprise de transport
The certificate, valid for a maximum of 6 months, must be kept in the vehicle and indicate:
- Registered office of the company for which the driver works, with a postal and electronic address;
- Name, surname, and date of birth of the person responsible for the seconding company, and designation of the social security agency to which the company makes contributions for the seconded employee;
- Name, place and date of birth of the seconded employee with the address of habitual residence, nationality, date of signature of employment contract (hiring) and applicable law, as well as professional qualification/contractual level;
- Gross hourly wage (which must not be less than the French minimum wage of EUR 9.76 gross hourly wage for 2017) and the methods for reimbursing travel expenses;
- Name and surname or company name of the French-based representative, indicating telephone numbers and postal and electronic addresses;
- Registration of the transport company in the REN National Electronic Register;
- Details of the French-based representative designated by the company
In addition, effective 1 April 2017, in implementation of the Macron Law applied to the third-party transportation sector, drivers of vehicles headed to France must request the A1 European Community Certificate from INPS, which verifies the social security agency in the drivers’ home country.
